Tax Form Filler — Terms of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) are a binding agreement between you and At Home VI, LLC (“AHVI,” “we,” “us”) governing your use of Tax Form Filler, the software service available at dashboard.athomevi.com (the “Service”). By creating an account, entering an access code, or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business, and “you” means that business. If you do not agree, do not use the Service.

2. The Service — Software, Not a Tax Preparer

The Service is software that helps you prepare US Virgin Islands and federal tax forms (such as Forms 722-VI, 720-VI, 941, and 1099-NEC), owner statements, and compliance calendars, based on information you provide.

AHVI is not a tax preparer, accounting firm, CPA firm, or law firm. We do not prepare, sign, or file tax returns on your behalf. We do not represent you before the Virgin Islands Bureau of Internal Revenue (BIR), the Internal Revenue Service (IRS), or any other tax authority. We do not provide individualized tax, legal, or accounting advice. The Service performs calculations and fills forms mechanically from your inputs; any informational content in the Service is general in nature. You review, sign, and file your own forms, and you are solely responsible for their accuracy and timely filing.

3. Eligibility and Accounts

You must be at least 18 and able to form a binding contract. Your email address serves as your account identity; you may also sign in via your athomevi.com membership (single sign-on). During the current invite-only beta, access requires an access code issued by AHVI. You are responsible for keeping your credentials and access codes confidential and for all activity under your account. Do not share access codes or resell access. We may suspend accounts that we reasonably believe are compromised or misused.

4. Free Tier

We currently offer a free tier to At Home members, limited to up to 5 properties, during the invite-only beta. The free tier is a courtesy: we may change its limits, features, or availability, or discontinue it, at any time.

5. Paid Subscriptions

Paid plans are sold directly by AHVI on a subscription basis:

Billing will be processed through a third-party payment processor (Stripe is planned). Subscriptions renew automatically each billing period until canceled. You may cancel at any time, effective at the end of the current billing period; you keep access until then. Fees already paid are non-refundable, and we do not prorate or refund partial months. We may change prices with advance notice; changes take effect at your next renewal.

6. Your Responsibilities

You are solely responsible for:

• the accuracy and completeness of all information you enter into the Service;
• reviewing every generated form before signing, submitting, or filing it;
• filing your own returns and forms with the correct authority, in the correct manner, by the applicable deadline — all filing deadlines remain your responsibility, even if the Service’s compliance calendar is incomplete or incorrect;
• maintaining your own records and backups of filed forms;
• securing the computer on which you run the local desktop vault (see Section 8); and
• complying with applicable law in your use of the Service.

Generated forms reflect your inputs. If your inputs are wrong, the output will be wrong.

7. No Tax, Legal, or Accounting Advice

Nothing in the Service — including calculated values, pre-filled fields, compliance calendars, reminders, help text, or documentation — constitutes tax, legal, or accounting advice. For advice about your specific situation, consult a licensed CPA, attorney, or enrolled agent. Use of the Service does not create any preparer, fiduciary, attorney-client, or accountant-client relationship with AHVI.

8. Data and Privacy

Our handling of your data is described in the athomevi.com Privacy Policy, including its Tax Form Filler section, which is incorporated into these Terms by reference. Key points:

• Business tax data you enter is stored on our U.S.-based servers; EINs are stored encrypted.
• Social Security Numbers are never stored on our servers. SSN-bearing forms are completed using a local desktop vault on your own computer. You are responsible for the security, backup, and retention of data in your local vault — if your computer or vault data is lost, we cannot recover it.
• We do not sell your data.

9. Availability; Beta Disclaimer

The Service is currently in beta. It is provided without any uptime commitment or service-level agreement (SLA). Features may change, break, or be removed; data formats may change; we may impose limits; access may be interrupted for maintenance or otherwise. We recommend downloading and keeping local copies of all generated forms. We will make reasonable efforts to operate the Service reliably, but during beta we make no availability commitments of any kind.

10. Intellectual Property

The Service, including its software, design, templates, and content (excluding your data and excluding government tax forms themselves), is owned by AHVI or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own business purposes during your subscription or authorized beta access. You may not copy, modify, reverse engineer, resell, or build a competing service from the Service. You retain all rights to the data you enter; you grant us a limited license to host and process it solely to provide the Service. Feedback you provide may be used by us without obligation.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT GENERATED FORMS OR CALCULATIONS ARE ERROR-FREE OR THAT THE SERVICE REFLECTS CURRENT TAX LAW, RATES, FORM VERSIONS, OR DEADLINES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) AHVI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, TAX PENALTIES, INTEREST, OR ASSESSMENTS, ARISING FROM OR RELATED TO THE SERVICE; AND (b) AHVI’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO AHVI FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (WHICH MAY BE ZERO FOR FREE-TIER USERS).

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, fail to pay fees when due, or if we discontinue the Service (with reasonable notice where practicable). Upon termination, your license ends; you should download your generated forms before closure. Data deletion after termination is handled as described in the Privacy Policy. Sections that by their nature should survive (including Sections 6, 7, 10, 11, 12, and 14) survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the US Virgin Islands, without regard to conflict-of-laws rules. Subject to the next sentence, disputes will be resolved exclusively in the courts located in the US Virgin Islands, and the parties consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time, especially during beta. If we make material changes, we will give notice (for example, by email or an in-product notice) before the changes take effect, and the updated effective date will be shown at the top of the Terms. Continued use of the Service after changes take effect constitutes acceptance.
